1. 概要
本研究は、第二次世界大戦後に連合国諸国がアジア・太平洋地域で展開した対日戦犯裁判を共通のクライテリアに基づいて比較分析し、統合的な視点から裁判を捉え、歴史的な意味を探究するものである。
戦争犯罪人を処罰するという考え方は、第一次世界大戦を契機に法的・制度的な体制構築が模索され、第二次世界大戦後に本格的な実行に移された。侵略戦争の計画・準備・実行に責任を負った主要戦争犯罪人については、ニュルンベルク、東京の国際軍事裁判で裁かれ、捕虜や民間人の虐殺、虐待等の残虐行為を実行、あるいは関与した旧軍兵士たち（非主要戦争犯罪人やBC級戦犯と呼称される）は連合国が各地に設置した軍事法廷で処罰された。本研究は、これら「戦争の裁き」のうち対日戦犯裁判―特にBC級戦犯裁判―を検討対象に据え、共同研究によって実証的な比較分析を行うものである。
BC級戦犯裁判は米英中仏蘭豪比の7カ国がアジア・太平洋の51カ所に設けた軍事法廷で実施され、日本軍将兵らの残虐行為の刑事責任を追及した。1945年2月のグアムでの米海軍裁判を嚆矢とし、51年4月のマヌス島の豪軍裁判で全裁判が終結するまで続けられた。従来の研究では、各国別にケース・スタディが重ねられてきたが、本研究では、対日戦犯裁判研究の第一人者が一堂に会し、共通の分析軸に基づいて共同で比較検討を行い、もって対日戦犯裁判の歴史的な役割、意義と限界を再考する。

3. 研究期間
本研究は2019年度～2020年度の2年間にわたって実施する。年度毎に広島と東京で研究会を複数回開催し、各裁判の実証分析と比較分析を深めていく。

The Japanese War Crimes Trials at Seventy: A Comparative Study on the B & C Class Trials

1. Outline
This project focuses on the Japanese war crimes trials, particularly the B & C class trials. After the end of World War II, General MacArthur established the International Military Tribunal for the Far East (the Tokyo trial) in 1946 and the Japanese political and military leaders were prosecuted as A class war criminals by 11 nations. The Allies also set up “B & C class war crimes courts” in 51 places in the Asia-Pacific region and held trials that prosecuted the defendants on war crimes charges such as mass murders and rapes. These trials were conducted from 1945 to 1951, and thus 2021 is a symbolic year as it is the 70th anniversary of the completion of the trials. Historians have previously conducted case studies of specific national trials (United States, United Kingdom, Republic of China, Australia, etc.). In contrast, this project pursues a comparative study based on common criteria for a historical reexamination of the trials. Since 2021 is the symbolic year, the project members intend to publish a scholarly book based on the research results.

3. Duration
This project is 2 year project. The members will hold several meetings in Tokyo and Hiroshima each year to discuss the comparative perspectives and the case studies of the trials.
